Charging pile into the community sad "property off"? This court in Jiangsu decided!
Many people choose to buy new energy vehicles, what if the property company does not agree to install charging piles in parking spaces? Gu, the owner of a community in Chongchuan District, Nantong, recently encountered such a trouble. On August 20, the Chongchuan District People's Court of Nantong City announced a dispute over a property service contract between an owner and a property company caused by the installation of charging piles. The court ruled that the property company stamped and agreed to the "Consent to the Construction Opinion" required by the owner to install the charging pile, and provided necessary cooperation and assistance during the on-site investigation of the power supply enterprise and the installation of the charging pile.
In March this year, Gu bought a new energy vehicle. In order to facilitate charging, he plans to install charging piles in his underground parking space. After consulting with the power supply company, Gu learned that to apply for the installation of charging piles, he needed to submit materials such as proof of ownership of the parking space, proof of car purchase, and proof of the property service enterprise's consent to install charging piles. As the owner of the parking space and vehicle, Gu's relevant certification materials are complete, but he encountered difficulties when applying for the community property company to issue a certificate of consent to installation, and the property company refused to stamp the certificate of consent to installation. After several unsuccessful negotiations, Gu sued the property company to the court.
During the trial, the property company said that there was no independent parking space for new energy vehicles in the community, and there were potential safety hazards in installing charging piles in underground parking spaces where new energy vehicles and fuel vehicles were parked. Moreover, the installation of charging piles in parking spaces involves the use of public parts, which will infringe on the rights and interests of other owners. In addition, the owner's request to cooperate with the installation of charging piles also exceeded the scope of the property service contract between the two parties. The court held that the owner's purchase and use of new energy vehicles is a positive response to the requirements of the national energy conservation and emission reduction strategy, and the charging pile, as the supporting infrastructure of new energy vehicles, is an important guarantee for promoting the development of the new energy vehicle industry, so the General Office of the State Council, the National Development and Reform Commission and other departments have issued a number of opinions and notices, clearly supporting the construction of electric vehicle charging infrastructure in residential areas and requiring property companies to assist and cooperate. As the owner of his parking space, Gu has the real need to install charging piles after purchasing new energy vehicles, so he has the right to apply for the installation of charging piles in private parking spaces.
Regarding the defense of potential safety hazards in the installation of charging piles in underground parking spaces proposed by the property company, according to the 2020 "Guiding Opinions on the Construction and Installation of Self-use Charging Facilities for Electric Vehicles in Residential Areas of Nantong City", the installation of charging piles requires the power supply enterprise to conduct a feasibility survey, formulate a charging pile access plan plan, complete the construction of supporting grid connection projects after confirming that the installation conditions are met, and then install charging facilities by enterprises with corresponding qualifications. Regarding the defense that the installation of charging piles infringed on the rights and interests of other owners raised by the property company, the court held that Gu's installation of charging piles in his parking space was the use of his exclusive property rights, and if the installation, wiring and wiring of the corresponding charging box involved the use of common parts or facilities, it was also a reasonable use of the common parts to realize the use value of the exclusive parts, and the defendant should cooperate and assist.
As for whether the installation of charging piles falls within the scope of the property service contract, according to the relevant provisions of the Civil Code of the People's Republic of China, if the parties have not agreed on the method of performance of the contract, they shall perform in a manner conducive to the realization of the purpose of the contract. Charging pile is an indispensable equipment to achieve the purpose of new energy vehicles, and the cooperation and assistance of the property company in the installation of charging pile is also a category for providing property services for the community and promoting the benign interaction between the property company and the majority of owners, which is conducive to the harmonious development of the community and is also the proper meaning of property service.
